Background

This case discusses the removal of objectionable content from social media platforms. Around 35 tweets were shared from the defendant’s handles and the same were re-tweeted, prompting the plaintiff to file a suit against defendant No. 1. The plaintiff requested the intervention of the court in compelling defendant No. 1 to remove a set of 29 URLs, which were not yet removed by him till date.

“Whether the plaintiff can seek from the defendants to take down the tweet URLs?” 

Decision

The court had previously observed that defendant No.1 had tweeted derogatory and disparaging comments against the plaintiff, its management and its employee and made baseless allegations, & had restrained defendant NO.1 from making further comments against the plaintiff as interim relief. 

Upon the observation that the URLs had not been taken down, the court ordered defendant No.1 to remove the Tweet from his Twitter account within 48 hours on the receipt of a copy of such replication from the learned counsel of defendant No. 3 (Twitter) giving the specified 29 sets of URLs which, the defendant No.3 will take down within 72 hours thereafter.
